Terms and Conditions of Participation

The Spoken Word Stories activation (Activation) is created and operated by Voyages Tourism Australia Pty Ltd ABN 82 146 482 591 (Voyages). Through your participation in this Activation you are acknowledging that you have read these terms and conditions and that you agree to be bound by them. Children must be accompanied by a parent/guardian who can provide consent on behalf of the child to participate and to be bound by these terms and conditions.

The Activation creates an opportunity for Guests of the Wintjiri Wiru and Sunrise Journeys experiences to create and submit an audio recording of themselves (Participants) expressing their reflections on the experiences (Recording). There is a maximum of two Recordings per Participant, any additional Recordings may be erased. The Recordings are intended for sharing, at Voyages discretion, with members of the Anangu community and the Wintjiri Wiru Working Group (in the case of Wintjiri Wiru) and the creative teams, including artists and Anangu communities, involved in the creation of Sunrise Journeys. Your Recording may also potentially be selected for inclusion on a Voyages’ public website, radio and/or social media. Participants are able to select with whom their Recording may be shared through the entry process (set out further below).

Sharing of Recordings for Feedback Purposes

1. Participants who have attended the Wintjiri Wiru experience may select for their Recording to be made available to representatives of the Anangu community and Wintjiri Wiru Working Group for the purpose of expressing their gratitude, reflections and connection to the experience. This is the minimum level of participation in the Activation which is deemed to have been consented to through participation in the Activation (the next level being publication on a public website set out below).

2. Participants who have attended the Sunrise Journeys experience may select for their Recording to be made available to creative teams, including artists and Anangu communities, involved in the creation of Sunrise Journeys for the purpose of expressing their gratitude, reflections and connection to the experience. This is the minimum level of participation in the Activation which is deemed to have been consented to through participation in the Activation (the next level being publication on a public website set out below).

3. Participants acknowledge and agree that Voyages may copy, share, use, adapt, edit and reproduce their Recording for purposes of undertaking and reporting on the Activation and sharing both internally to Voyages employees, contractors, representatives, agents, directors and officers and externally to representatives of the Anangu community and Wintjiri Wiru Working Group (in the case of Wintjiri Wiru) and the creatives teams, including artists and Anangu communities involved in the creation of Sunrise Journeys.

Publication of Recordings

4. Where Participants have checked the box on the entry form which indicates consent for their Recording to be published, these Recordings will be reviewed by Voyages employees and representatives and some Recordings may be selected for publication on a Voyages operated website (Website). Selection of Recordings for publication will be in the absolute discretion of Voyages.

5. Participants acknowledge and agree that:

(a) their name may be included to accompany the Recording on the Website.

(b) Voyages may copy, share, use, adapt, edit and reproduce the Recording for purposes of conducting the Activation, Voyages reports, events, publications, promotional material, online via websites, in emails, radio and on social media platforms.

Entry Method

6. To participate in the Activation, Participants must follow the entry method which involves:

(a) providing certain personal details such as name and email address;

(b) indicating whether you attended Wintjiri Wiru or Sunrise Journeys;

(d) indicating whether you opt-in to subscribe to our marketing newsletter and notifications; and

(e) indicating your acceptance of these terms and conditions.

Marketing Opt-In

7. By ticking the marketing opt-in box when entering this Activation, Participants agree to be subscribed to Voyages’ mailing list, receiving emails about the latest news and promotions from Voyages and to the collection, use and management of your personal information as described in our Privacy Policy. Please read Voyages' privacy policy available on Voyages website at https://www.voyages.com.au/privacy-policy which tells you how we use any personal information we may collect about you through your participation in this Activation. You can opt out at any time.

Personal Information

8. Voyages may, for an indefinite period, unless otherwise advised, collect personal information through the Activation and use and disclose the information to conduct the Spoken Word Stories Activation for purposes of promotion, marketing, publicity, research and profiling purposes, including sending electronic messages to the Participant and any other purpose set out in Voyages' Privacy Policy. Please read Voyages' privacy policy available on Voyages website at https://www.voyages.com.au/privacy-policy which tells you how we use any personal information we may collect about you through your participation in this Activation. Participants should direct any request to opt out, access, update or correct information to Voyages. Personal information collected through the Activation may include first name, last name, contact phone number, email address, and age group. Voyages may disclose personal information to subsidiary and related companies, third parties or regulatory bodies, including but not limited to agents, contractors and service providers for the purposes set out in this clause.

Appropriate Conduct

9. We have a zero tolerance for verbally abusive or offensive language or racially insensitive, disrespectful, insulting or offensive comments used in Recordings submitted as part of the Activation. Statements or conduct that threaten prohibited or illegal activity will also not be tolerated.

10. Incomplete, incoherent entries and entries containing offensive, defamatory or otherwise containing inappropriate material will be invalid.

General Terms and Conditions

11. By participating in this Activation, Participant agrees to grant Voyages a perpetual and non-exclusive licence to use their Recording in all media worldwide and will not be entitled to any fee for such use. Participants also consent to the use and publication of their name without any further reference or payment. Participants may request for Voyages to limit the amount of personal information that is used or published in the promotional, PR and marketing materials. Such requests should be directed to our Privacy Officer with contact details contained in Voyages’ Privacy Policy https://www.voyages.com.au/privacy-policy.

12. Participant releases Voyages and its employees, representatives, contractors, agents, directors and officers, related body corporates and affiliates from all claims, actions and liabilities arising from or in connection with the use of their Recording including the use of their name, voice and performance as embodied in the Recording.

13. Participant acknowledges and agrees that they can request that Voyages stop using their name, or voice for the Activation and that Voyages will, to the extent possible, comply with such request in relation to the Recording which is in its possession and control. Participant acknowledges that Voyages may not be able to comply with such request in relation to a Recording which has been publicly released or published and no longer solely in Voyages’ possession or control.

14. Except for any liability that cannot by law be excluded Voyages (including its respective officers, employees and agents) excludes all liability (including negligence) for any loss or damage (including loss of opportunity) whether direct, indirect, special or consequential, arising in any way out of the Activation including:

(a) any technical difficulties or equipment malfunction (whether or not under Voyages’ control);

(b) any theft, unauthorised access or third party interference with Participant entries and/or Recordings; and/or;

(c) any entry that is altered, damaged or misdirected (whether or not after their receipt by Voyages) due to any reason beyond the control of Voyages.

15. If the Activation is not capable of running as planned including by reason of technical failure or any cause beyond Voyages' control, Voyages may cancel or suspend the Activation in its absolute discretion at any time and for any period of time.

16. Voyages reserves the right in its sole discretion and for any reason to reject and/or delete any submissions of any individual.

17. Participant agrees that the consents and rights granted in these terms and conditions will be binding on their heirs, beneficiaries and successors.

18. The laws of New South Wales apply to this Activation. Participants submit to the exclusive jurisdiction of the laws of New South Wales.
